Gennady Fedynich: "Those who choose passive strategy – choose authorities` strategy"

For the last year, the independent trade-union movement of Belarus saw a lot of changes. All the independent trade unions got united "under the umbrella" of the BKDP (Belarusian Congress of Democratic Trade Unions). However, debates on the tactics and strategy of trade-union movement never stopped. What should the modern Belarusian independent trade unions look like? What could the potential for their progress be and what is the reason of putting a spoke in each other's wheels? The Praca-by.info had a talk on these topics with Gennady Fedynich, Chairman of the Belarusian Independent Radio and Electronic Workers' Union (REP).

News BNP activists are ready to file hundred suits against "Delta Style" 30.06.2010

The managers of the sewing enterprise – Joint Limited Liability Company (JLLC) "Delta Style" – continue breaching the rights of members of the primary organization of the Belarusian Independent Trade Union (BNP) by refusing to make non-cash transfers of membership fees. Formally, the employer obeyed to the court ruling and transferred the fees, but only of the three members of the trade union, who had addressed the court; while the applications of other 98 members were ignored.

Let us remind you that the city authorities of Soligorsk and the administration of the JLLC "Delta Style" are hampering the work of the BNP unit in every possible way: the city executive committee refuses to register the organization, while the employer would not transfer membership fees.

The Soligorsk District Court, where the union activists applied for help, has obliged the administration to make cashless transfers of membership fees. The employer has formally treated the court ruling, and made a money transfer only for those three workers, whose suits had been satisfied by the court; although 101 applications on cashless transfer of trade-union fees had been submitted to the accounting office of the company – from all the members of the BNP primary organization.

"It's a roughest violation of the law," Alexander Fedukovich, the BNP accountant, makes her comments on the situation. "I've been working for many decades in this sphere, but I can't remember another case of such legal lawlessness. Even if an enterprise has only one BNP member, the accounting office is obliged to transfer his or her trade-union fees.

The press service of the BNP reports that now a letter was sent to the head of the JLLC "Delta Style" with a demand to stop violating the law and start making cashless transfers of trade-union fees of all BNP members, as prescribed by the legislation.

"Should the administration fail to react to this letter, we'll insist on respect of the law through the 'Bellegprom' Concern (state-owned concern of light industry) and the Ministry of Labour and Social Protection," said Alexei Skripal, the BNP legal inspector. "Moreover, as I know, this issue is under special supervision by the Ministry. If this doesn't work either, then we'll use other methods to force the company bosses to observe the law – with the help of the prosecutor's office and the court.

If we follow the logic of the company's administration, the remaining 98 BNP members, working at the enterprise, should also bring actions against the employer. According to Mr Skripal, if necessary, the union will do it.

"We'll go to court with one hundred statements of claim, filed by all the BNP members working at the JLLC "Delta Style"; and let the employer prepare money to pay court expenses," he has noted.

"The lawlessness existed, exists and, most probably, will exist," Natalia Mikhnyukevich, leader of the Soligorsk regional BNP organization, has regretfully added. "We did whatever we ever could to solve the problem. But we're not going to stop. Otherwise, how can we look into people's eyes?"
